CLARITY Act Cloture Vote Hangs by a Thread as Last-Minute Negotiations Collapse

The Digital Asset Market Clarity Act, the most sweeping crypto legislation ever to reach the Senate floor, headed into a critical procedural cloture vote on September 15 with its prospects sharply diminished after a last-ditch round of bipartisan negotiations broke down hours before the 2:15 p.m. ET deadline. The bill, H.R. 3633, would establish the first formal regulatory framework for digital assets in U.S. history and split oversight between the SEC and the CFTC, with the CFTC taking the larger role.

Republicans said they had offered 126 separate changes to accommodate Democratic demands, with lead Senate sponsor Cynthia Lummis declaring "the time for negotiating is over" after Democrats sent a counteroffer that GOP negotiators promptly rejected. Lummis later warned that a failed cloture vote would effectively kill the bill, calling the moment "now or never." Treasury Secretary Scott Bessent added administration pressure by framing the bill as a tool to combat regulatory "evasion."

Democrats showed no sign of consolidating behind the Republican text. Senator Kim, speaking to reporters, said "there's more work to be done" and appeared to lean against voting for cloture without explicitly committing to a no vote. The 60-vote threshold required to advance the bill looked increasingly out of reach, and CoinDesk reported that the odds of passage had plunged. Bitcoin fell to $77,000 ahead of the vote, reflecting trader concern that the bill would stall. The CLARITY Act had already been delayed once when the Senate left for its August recess without holding a vote, and pressure to pass it before the November midterms added urgency to a process that appeared to be unraveling.
