Senate CLARITY Act Fails Key Procedural Vote as Crypto Legislation Collapses

The CLARITY Act, a sweeping 635-page bill that would have established the first comprehensive regulatory framework for the U.S. cryptocurrency sector, failed its key procedural hurdle in the Senate on Tuesday, effectively killing the legislation for 2026. The bill needed 60 votes to clear the cloture threshold, requiring all 53 Republicans plus at least seven Democrats or independents to back it, a bar it fell short of after last-minute bipartisan negotiations broke down.

Sen. Cynthia Lummis, the bill's lead Republican sponsor, had urged colleagues to vote yes, noting that Democrats had secured 126 concessions during negotiations and authored more than half of the bill's text. Hours before the vote, Lummis called the moment "now or never," warning the bill was finished if the procedural vote failed. Republicans had rejected a Democratic counteroffer earlier in the day, and the chamber went to vote without a deal in place.

The collapse is a significant setback for the crypto industry, which had invested heavily in lobbying to advance federal digital-asset legislation. Separately, Treasury Secretary Scott Bessent expressed support for $5,000 direct payment checks for Americans, and Attorney General Todd Blanche said the Trump administration would comply with a Supreme Court ruling blocking the U.S. Postal Service from enforcing new restrictions on mail-in ballots ahead of November's midterm elections.
