Supreme Court Lets Trump White House Ballroom Construction Continue Pending Full Review

The Supreme Court on Friday, August 21, allowed President Trump to continue construction of a sprawling new ballroom adjoining the White House, temporarily blocking lower court rulings that had ordered the project to stop. Chief Justice John Roberts issued a brief administrative stay that freezes a federal district court injunction, which had been set to take effect the same day, while the justices weigh a more lasting decision on whether construction should be paused during ongoing litigation.

The ruling does not address the legality of the project. Two lower courts, including a D.C. Circuit appeals panel that ruled 2-1 on August 7, had found Trump likely lacked authority to proceed without congressional approval, demolishing the White House East Wing and erecting a ballroom in its place. The National Trust for Historic Preservation, which brought the lawsuit, argues the president cannot unilaterally build over the East Wing without Congress authorizing it. A key procedural question before the justices is whether the trust has legal standing to sue based on an objecting member's aesthetic concerns.

The project, which the administration describes as a military center and ballroom complex, is estimated to cost taxpayers at least $300 million to $400 million, despite Trump's earlier claims that taxpayers would not pay. A 250-person crew has been working 20-hour days, seven days a week, according to a Trump administration filing. Roberts' stay remains in place "pending further order" from the court, meaning construction continues until the justices issue a more definitive ruling on whether to halt work while the case proceeds.
