Supreme Court Reinstates Trump Voter Eligibility Database Ahead of November Midterms

The Supreme Court ruled Thursday that the Trump administration can deploy an expanded federal database to verify voter citizenship, reversing a lower court's block in a decision that came over three liberal dissents. The ruling allows the administration to use the revamped version of SAVE, the Systematic Alien Verification for Entitlements system, in the run-up to November's midterm elections, when Republicans are defending their narrow congressional majority.

SAVE is a 40-year-old federal system originally built to check the immigration status of noncitizens applying for public benefits. The Trump administration overhauled it by linking it for the first time to Social Security Administration records, which cover most Americans, and by allowing bulk queries so states can upload entire voter rolls for citizenship checks. Critics argued the expansion misuses Social Security data and violates privacy rights, concerns the lower court found credible before the Supreme Court put that ruling on hold.

The system can now be used to scrub voter rolls and potentially to challenge election results, and DHS has been encouraging states to use it to compile lists of adult citizens ahead of November. Trump has framed the effort as targeting noncitizen voting, though studies have repeatedly found that to be a rare occurrence. Justice Sotomayor wrote in dissent that the ruling does not resolve whether the administration has constitutional or statutory authority to implement these directives, signaling the legal fight will continue after the election.
